Default '07 engine problem (replacement)

Has anyone had to have the engine replaced in their Mini? I have a 2007 that I've not even had for 3 years and I have to replace the engine due to a bad piston rod in the #1 cylinder. I called customer relations at Mini and they won't help pay for it, either (out of warranty). As far as I'm concerned, it's a defective part. The cost is $5,800. Needless to say, I'm not going to keep it once I get it back.
