Default performance upgrades and emmissions?

Has anyone had problems with their performance upgrades making their mini fail emmissions? I've been toying with the idea of doing some work to the motor, but it still has to pass emmission testing once a year..

Pulley, tune, JCW intake and exhaust here and no problems.

I had the car tuned. As in, they changed around software specifications until it made the maximum amount of power it could.
