buy or not buy? (are these bad problems?)

Default buy or not buy? (are these bad problems?)

I've the bug... I NEED to have a mini S.

I finally found one used that I like. Color. S. Auto. price is good. etc. It's a 2006 with 40,000 miles. I've checked the usual spots (exhaust clean, engine clean but not too clean, no rust under the body, etc.) and everything seems to be of sound build. I'm also buying from a reputable/national car sales company. It'll have a 4 year warranty on it.

The only thing is when test driving, the DSC light stays on and won't go away. There is also a "service engine soon" light. The dealer said that they will work on this (free of course) before I take possession.

I know it's hard to tell until I know exactly what is wrong with it. Would you suggests I buy it since they will fix it? Or is this a bad sign that it already has these (2) "errors" at so early in her life?

Googling around shows that the "service engine soon" may be just a known issue with the O2 sensor which is easily fixed. If so, I'm cool with that. How about the DSC?

Any thoughts? I really love this thing already but I dont' want to make a purely emotional decision. Help me!

One more question if I may. The engine oil looks clean but I assume they used just the cheap stuff. What other maintenance things should I do asap on her? spark plugs? transmission oil change? To be conservative, I'll assume these haven't been done yet just in case.

With 40K they maintenance should have been done at 36k ...
When you start it it should say mileage to oil change ...
If the DSC light stays on it might have been programmed to be off at all times (or has an ian cull auto up circuit) have you tried hitting the middle switch to see if it turns off ???
CEL can be scanned at any parts store it can be thousands of things (knock sensor ) is a common trouble if they ran low grade gas in it (premium only in an S)
